Asian Indian Names Figure in H1B Visa Fraud Indictments

Federal agents arrested 11 individuals in 6 states Wednesday as part of an investigation into suspected visa and mail fraud. Matthew G. Whitaker, United States Attorney for the Southern District of Iowa, announced the operation, which was carried out by federal, state and local law enforcement agencies in Iowa, California, Massachusetts, Texas, Pennsylvania, Kentucky, and New Jersey.

VISION SYSTEMS GROUP, INC., a New Jersey Domestic Profit Corporation, with a branch office in Coon Rapids, Iowa, was also indicted in a ten count federal indictment that included one count of conspiracy, eight counts of mail fraud, and one count of ‘Notice of Forfeiture’ in the amount of $7,400,000.

“Today’s multi-state enforcement action is the result of an extensive, ongoing investigation into suspected H1B visa fraud, mail fraud, and conspiracy,” said U.S. Attorney Whitaker. “Dubbed Operation Pacific Vision, this investigation is the result of outstanding cooperation and collaboration among law enforcement agencies at all levels of government.”

The investigation is being conducted by U.S. Immigration and Customs Enforcement (ICE) in collaboration with U.S. Citizenship and Immigration Services - Fraud Detection and National Security Division (FDNS); U.S. Department of Labor - Office of Inspector General; U.S. Postal Inspection Service (USPIS); U.S. Department of State; Social Security Administration - Office of The Inspector General, and is supported by the U.S. Attorney’s Office for the Southern District of Iowa.

“This case highlights the Department of Homeland Security’s commitment to identifying and dismantling visa fraud schemes,” said Homeland Security Acting Assistant Secretary for ICE John P.

Torres. "Ensuring the integrity of our nation's legal immigration system is a top priority for ICE.”

“This is a prime example of how the Department of Homeland Security identifies fraud,” said Michael Aytes, U.S. Citizenship and Immigration Services (USCIS) Acting Deputy Director. “Our adjudication officers can spot inconsistencies during the application process that ultimately lead to the successful outcome we’re seeing today. Visa fraud undermines the integrity of the immigration system and I’m proud that our officers have helped to ensure that the American people and our customers can continue to depend on a reliable system.”

Federal authorities, with assistance from state and local law enforcement, served search warrants at addresses in Urbandale and Clive, Iowa; in Santa Clara, Rancho Cucamonga and Arcadia, Calif.; and in South Plainfield, N.J.

This investigation involves companies that sponsor primarily H-1B non -immigrants, or temporary workers in specialty occupations that require particular expertise. The companies that are the subject of this investigation have asserted that the foreign workers have been brought to the U.S. to fill existing vacancies. However, the companies allegedly have not always had jobs available for these workers, thereby placing them in non-pay status after they arrive in the United States. In some cases, the foreign workers have allegedly been placed in jobs and locations not previously certified by the Department of Labor, displacing qualified American workers and violating prevailing wage laws. The companies and foreign workers have allegedly submitted false statements and documents in support of their visa petitions. The false statements and documents were mailed or wired to state and federal agencies in support of the visa applications. The companies are suspected of visa fraud, mail fraud, wire fraud, money laundering and conspiracy.

“The foreign labor certification programs are designed to permit U.S. employers to hire foreign workers to fill jobs essential to American businesses,” said Daniel R. Petrole, Deputy Inspector General, United States Department of Labor. “Our agency remains resolute in its commitment with its law enforcement partners to investigate fraud committed against these Department of Labor programs.”

U.S. businesses use the H-1B program to employ foreign workers in specialty occupations that require theoretical or technical expertise in specialized fields, such as scientists, engineers, or computer programmers. As part of the H-1B program, the Department of Homeland Security (DHS) and the Department of Labor (DOL) require U.S. employers to meet specific labor conditions to ensure that American workers are not adversely impacted, while the DOL’s Wage and Hour Division safeguards the treatment and compensation of H-1B workers. Congress sets a numerical cap for the admission of skilled workers into the U.S. The current H-1B cap is set at 65,000 per fiscal year. H-1B aliens can work in the United States for three years, with an option for an additional three years (for a maximum of six years).

As with any criminal case, a charge is merely an accusation; a defendant is presumed innocent until and unless proven guilty.

Tresa Baldas of Detroit Free Press reports that Babu Bhai Patel

lives in a half-million-dollar home, which has a mortgage, and owns 26 pharmacies with 80 employees. He also is vice chairman of the Hindu Temple of Canton. He has one misdemeanor conviction from 1997, although the crime was not disclosed in records.

"Mr. Patel is not a portrait of the common criminal or drifter," Patel's lawyer, Martin Crandall, wrote in court documents. "There is no risk he would flee."

Since Patel's indictment, several in the Hindu community have come to his defense. More than 20 supporters showed up for a detention hearing Tuesday. Several character reference letters have been filed with the court -- including one from the president of the Hindu Temple -- and many offer their homes as collateral to secure Patel's release.

Tri Valley University Part2 is University of Northern Virginia and a large number of students are from Hyderabad, Andhra Pradesh.  About 2,400 students of which 90 per cent are from India, are registered at three locations of University of Northern Virginia. Jackie Bensen writes

The school is not closed, and students can attend class.  Foreign-born students at the campus Thursday said they have attended classes in the building and earned degrees from the school. One said the school helps students get their student visas.  The University of Northern Virginia is an unaccredited, for-profit private university that calls itself the most popular American university for students from India. Thousands of students are registered at three locations in northern Virginia.  If the investigation discovers the school improperly handled student visas, the school could face severe penalties.

Can't desis live without glorifying Hindu preachers, Hindu priests, Swami Nithyananda or Sai Baba?  Can't desis live without building Sai Baba temples, Swami Narayan temples?    

Leave Swami Nithyananda alone.  Leave gang banger Governor N.D. Tiwari alone.  Let them get their consensual fook on.

According to ABN Andhra Jyothy, one Radhika, had approached Governor ND Tiwari’s aide Aryandra Sharma, seeking allotment of a mine.  The report alleged that she had “supplied” some women to the ND Tiwari, at the instance of Aryandra Sharma.  However, Radhika she did not get the expected favour from ND Tiwari  Radhika then contacted Andhra Jyothy.  

Vemuri Radhakrishna, managing director of ABN channel and Andhra Jyothy, defended the footage and said that the report was aired after verification and cross checking and editing more graphic parts of the foursome.

It appears that ND Tiwari was having consensual sex. He may have even protected the interests of the people of Andhra Pradesh by being less than helpful with the mine allotment.

Even Sonia Madam might understand a threesome but foursome; ND Tiwari, you lucky bastard, you went out with bang, bang, bang.

We Telugus have a problem staying united. First there emerged this vast division in the castes (thanks to our late CM, NTR) and now the Telanga issue, where an ex-minister called K. Chandrashekar Rao (referred to as ‘KCR’) who was kicked out of Chandra Babu Naidu’s cabinet on corruption charges, suddenly realizes that the government of AP has been neglecting ten North Western districts in AP and decided to call for separate state! The guy had done enough damage to the peace of the state and is continuing to do so.

Politics at home aside, now, what’s happening in the city of Cleveland? Thankfully, it’s not about caste or region (or is it? Hope not!).

Apparently some friction has developed between the ‘original founders’ of the Telugu Association. Though the reasons are not very clear, the email war that went on between these founders clearly shows that it was war for control and a war of egos. What’s the result? A split!

Now, I'm not sure if there are two associations or more than two. However, there are at least three websites that I know of.

Each of these Telugu Associations has a copy of the members list and their email addresses. Each of these associations is sending emails and asking members to RSVP to their cultural activities and also pay their yearly membership dues!

Here’s a thing the founders and organizers and the active members should understand - Not all Telugu speaking people living in this area want to be part of the association and the turn-out in most of the previous cultural programs organized by the association has been low. If you want to generate interest and improve the participation then, set aside your petty quarrels and please not turn this into a bigger joke than it is!!

Murder of Sejal Patel of Twinsburg, Ohio

 Judge Brenda Burnham Unruh sentenced Chetan Patel to 30 years to life and his mother, Minaxi, to 25 years to life in prison.

The two were found guilty last week of aggravated murder, tampering with evidence and gross abuse of a corpse in the murder of Sejal Patel, 28, in July 2005. Sejal Patel was a resident of Pinebark Place, a suburb on the southeast of Cleveland, Ohio.

What I have been told by a Patel friend, that the tug of war between a mother in law and the daughter in law in the Patel community is not uncommon and sometimes can reach a disturbing level.

I suppose its likely that if Sejal Patel was victimized in India, the perpetrators would have escaped the consequences. For Sejal Patel, the American justice system worked.

I think, probably, the origin of these types of problems can be traced back to how Patel, Gujrati and the desi society is structed in India. I think the odds are that my Patel friend will say that there definitely are more Sajel Patels and people like her tormentors in the Patel society in India.

The Old Cleveland Desi Doctor Fart

I run into this old desi doctor fart at a Cleveland desi community event location that I would rather not mention, who identified himself as a orthopedic surgeon. One would think that this condescending gandu would become a bit wiser with age and maybe the education required to become a surgeon.

One potential explanation is that he probably still carries the feudal attitude prevalent in India. An another potential reason might be that this desi surgeon asshole made a few dollars doing what he does and since then shoves his head up his own rectum and smells flowers.
